讲座内容简介:

The U.S. Supreme Court has interpreted the Fifth Amendment to prohibit the government,s taking of private property without the payment of just compensation. This constitutional theory has also been applied to situations when the government has conditioned land development approval upon the private owner,s donation of lands or money to the government. These regulatory conditions have become known as "exactions." In June, 2013 the Court decided the Koontz v. St. John,s River. Water Management District case and it expanded this constitutional limit on government authority. This presentation will assess the impact of this case on Takings law and on the power of government to use exactions for public purposes.
